Terms of Service & Simulation

By accessing https://fidua.eu or using the Fidua pre-wire verification simulator, you agree to these minimal Terms of Service.

1. Description of service

Fidua provides B2B SaaS software infrastructure designed to generate pre-checkout verification context and Private Verification Documents (PVDs) for high-value asset transactions.

2. Regulatory status and perimeter

Technical Service Provider. Fidua is a Technical Service Provider (TSP) operating under the exclusion of Article 3(j) of EU Directive 2015/2366 (PSD2).

No fund custody. Fidua is not a financial institution, bank, or payment service provider. Fidua never receives, holds, routes, or manages client funds. Wire transfers are executed independently between transacting parties.

3. Statutory Wwft record-keeping

Participating merchants retain sole responsibility for exporting and storing the generated Private Verification Document (PVD PDF) to fulfill statutory 5-year record-keeping obligations under Article 33 of the Dutch Wwft (or European equivalent). Fidua maintains immutable Merkle root hashes in-database strictly for document authenticity verification.

4. Pre-incorporation and simulation disclaimer

Fidua currently operates as a technology project in formation (B.V. i.o.). Interactive demonstrations and sandbox environments are strictly for evaluation by prospective design partners and advisors. Output documents represent simulated verification data until commercial go-live.

5. Governing law

These terms are governed by the laws of The Netherlands.
